Vietnam: New technical regulations for vehicles

 

Vietnam has published three new technical regulations for vehicles:

  • Draft National Technical Regulation on safety and environmental protection for automobiles for new assembled, manufactured and imported automobiles, QCVN 09:2023/BGTVT;
  • Draft National Technical Regulation of road vehicle headlamps;
  • Draft National Technical Regulation on mirrors for automobiles, Amendment 01:2023 QCVN 33:2019/BGTVT.

The first one stipulates requirements for quality assessment of technical safety and environmental protection of types of cars that are manufactured, assembled and imported for use in Vietnam as defined in TCVN 6211 “Road vehicles – Types – Terms and definitions”, TCVN 7271 “Road vehicles – Motor vehicles – Classification in purpose of use”, Pure electric vehicles, Hybrid vehicles, Hybrid electric vehicles, Hydrogen Vehicles, Electric Hydrogen Vehicles, Automated Vehicles, Self-Propelled Vehicles and Off-Road Vehicles (hereinafter referred to as vehicles).

The second one stipulates requirements for quality assessment of road vehicle headlamps.

The third one regulates technical requirements and testing methods for mirrors, cameras and screens for cars as defined in TCVN 6211 “Road vehicles – Types – Terms and definitions”.  It does not apply to mirrors, cameras and screens installed on cars for national defense and security purposes and other observation devices that can display the driver’s viewing range as specified in Appendix A of this Regulation.

The new regulations relate to the existing vehicle legislation is Vietnam, e.g. to:

– Law on Road Traffic dated November 13, 2008;

– Law on Standards and Technical Regulations Law dated June 29, 2006;

– Law on Promulgation of Legal Documents dated June 22, 2015;

– Decree No. 127/2007/ND-CP dated August 1, 2007 and Decree No. 78/2018/ND-CP dated May 16, 2018 amending and supplementing a number of articles of Decree No. 127/ 2007/ND-CP;

– Decree No. 74/2018/ND – CP dated May 15, 2018 amending and supplementing a number of articles of the Law on product and goods quality;

– Decree No. 56/2022/ND-CP dated August 24, 2022 of the Government regulating the functions, tasks, powers and organizational structure of the Ministry of Transport;

– Decision No. 2060/QD – TTg dated December 12, 2020 approving the national strategy to ensure road traffic order and safety in the period 2021 – 2030 and vision to 2045 of the Prime Minister;

– Circular No. 05/2020/TT-BGTVT dated February 26, 2020 amending and supplementing a number of articles of Circular No. 03/2018/TT-BGTVT of January 10th, 2018 regulating quality inspection of technical safety and environmental protection for imported motor vehicles subjected to Decree No. 116/2017/NĐ-CP

– Circular No. 25/2019/TT-BGTVT dated July 5, 2019 on quality inspection of technical safety and environmental protection in automobiles assembly and manufacture; Protection of the environment; Quality requirements
