Ecuador: New regulation for brake fluids for hydraulic systems

 

Ecuador has published a new regulation for brake fluids for hydraulic systems: Reglamento Técnico Ecuatoriano PRTE 031 (2R) “Líquido de frenos para sistemas hidráulicos. It will come into force on 1 April 2025.

The regulations references the international standard ISO 4925.

Furthermore, the following packaging and labelling requirements are given:

5.1 The labeling information must be presented in a visible place; marked or printed permanently and indelibly, with clear and easy-to-read characters, in Spanish, without prejudice to the fact that they may also be presented in other additional languages.

5.2 The products subject to this Ecuadorian technical regulation must contain the labeling information on a label on the container or marked directly on the container.

5.3 All letters on the label must appear on the container with a minimum height of 3.2 mm.

5.4 The product labeling must contain at least the following information:

5.4.1 Designation: The container for non-petroleum-based brake fluid must contain a text (in capital letters) that refers to: NON-PETROLEUM-BASED BRAKE FLUID ISO 4925

5.4.2 Production identification: Serial number that identifies the packaging batch and the packaging date.

Regarding the conformity assessment, the following requirements are laid down:

8.1 In accordance with the provisions of the Ecuadorian Quality System Law, prior to the commercialization of national and imported products subject to technical regulations, compliance must be demonstrated through a product conformity certificate issued by a product certification body accredited or recognized by the Ecuadorian Accreditation Service SAE; or, designated in the country by the Ministry of Production, Foreign Trade, Investments and Fisheries; or, by those that have been issued in relation to the current mutual recognition agreements with the country.

8.2 Inspection and sampling. To verify the conformity of the products with this Ecuadorian technical regulation, sampling must be carried out in accordance with: The sampling criteria established in the technical standard applied in numeral 4 of this Ecuadorian technical regulation; or, The sampling plan established in the ISO 2859-1 standard, for a special inspection level S-1, normal simple inspection and an AQL = 4%; or, According to the sampling procedures established by the product certification or inspection body, accredited, designated or recognized in accordance with numeral 8.1. The competent control bodies or entities may apply inspection or sampling criteria different from those established in this Ecuadorian technical regulation, in accordance with their control procedures and the current legal system of the country.

8.3 Presentation of the Product Conformity Certificate. Issued by a product certification body accredited, designated or recognized in accordance with numeral 8.1, for this Ecuadorian technical regulation or equivalent technical regulations. The equivalences must be validated by the Ecuadorian Standardization Service. National manufacturers and importers of products covered by the scope of application must demonstrate compliance with the requirements established in this Ecuadorian technical regulation or equivalent technical regulations, through the presentation of the product conformity certificate according to the following options:

8.3.1 Product Conformity Certificate according to Certification Scheme 1b (batch), established in the ISO/IEC 17067 standard, issued by a certification body
