Ukraine: Updates to type approval regulation 

 

Ukraine notified the adoption of Resolution of the Cabinet of Ministers of Ukraine No. 389 “Some Issues of Approval of the Design of Vehicles, Their Parts and Equipment” of 25 March 2026 (concerning the adoption of the Technical Regulation for approval of the design of vehicles, their parts and equipment). 

The Resolution will enter into force six months after its publication, i.e. on 27 September 2026. 

The Resolution establishes that: 

– the making available on the market of wheeled vehicles, their parts and equipment which comply with the requirements of the Procedure for Approval of the Design of Vehicles, Their Parts and Equipment, approved by Order of the Ministry of Infrastructure No. 521 of 17 August 2012, and which were placed on the market prior to the entry into force of this Resolution, shall not be prohibited or restricted on the grounds of non-compliance with the requirements of the Technical Regulation; 

– authorized bodies and conformity assessment bodies designated to carry out conformity assessment activities in accordance with the Procedure for Approval of the Design of Vehicles, Their Parts and Equipment, approved by Order of the Ministry of Infrastructure No. 521 of 17 August 2012, prior to the entry into force of this Resolution, shall continue to carry out conformity assessment activities within their designated scopes in accordance with the Technical Regulation. 

The Resolution also introduces amendments to Resolutions of the Cabinet of Ministers of Ukraine No. 419 of 1 July 2016 “On Approval of the Procedure for the Designation, Refusal of Designation and Withdrawal of Designation of Certification Bodies for the Individual Approval of Vehicles, Their Parts and Equipment” and No. 1069 of 28 December 2016 “On Approval of the List of Product Types Subject to State Market Surveillance by State Market Surveillance Authorities”, and provides for the repeal of certain Resolutions of the Cabinet of Ministers of Ukraine in accordance with the list annexed to it.
