Canada: Updates to the Canada Motor Vehicle Standard (CMVSS) 114 – Theft Protection and Rollaway Prevention

 

Transport Canada is proposing amendments to the Motor Vehicle Safety Regulations (MVSR), specifically to Canada Motor Vehicle Safety Standard (CMVSS) 114 – Theft Protection and Rollaway Prevention. The proposed changes would modernize the regulation by replacing references to outdated vehicle immobilization system standards with updated versions that align with current international theft-protection requirements.

Under the proposal, the static incorporation by reference of CAN/ULC-S338-98 would be replaced with ANSI/CAN/UL/ULC 338:2025. In addition, the amendments would adopt the general and specific technical requirements set out in Section 5 of UN Regulation No. 162 through ambulatory incorporation by reference of the 00 series of amendments. The proposal would also repeal subsections (8) to (21) of CMVSS 114, which were developed by Transport Canada, as well as remove references to UN Regulations No. 97 and No. 116.

Consequential amendments are also proposed to subsection 12.1(2)(c) of the MVSR to update the reference from CAN/ULC-S338-98 to ANSI/CAN/UL/ULC 338:2025. This change would ensure that imported vehicles meet, or are modified to meet, Canadian safety requirements consistent with the updated CMVSS 114.

The proposed amendments include a two-year transition period before mandatory compliance is required.
