Automotive regulatory framework
The Ministry of Road Transport and Highways (MoRT&H) serves as the central governing body overseeing automotive and vehicle regulations in India. It holds authority over various aspects, including driving licenses, motor vehicle registration, traffic control, and vehicle construction and maintenance, in accordance with the Motor Vehicles Act, 1988 (MVA) and the Central Motor Vehicles Rules 1989 (CMVR).
Advising MoRT&H on technical matters related to CMVR is the CMVR – Technical Standing Committee (CMVR-TSC), comprising representatives from organizations such as the Ministry of Heavy Industries & Public Enterprises (MoHI&PE), Bureau of Indian Standards (BIS), and testing agencies like the International Centre for Automotive Technology (ICAT) and the Automotive Research Association of India (ARAI). This committee collaborates with industry bodies like the Society of Indian Automobile Manufacturers (SIAM), Automotive Component Manufacturers Association (ACMA), and Tractor Manufacturers Association (TMA), as well as representatives from State Transport Departments.
Assisting the CMVR-TSC is the Automobile Industry Standards Committee (AISC), which focuses on drafting safety-related technical standards. Its responsibilities include formulating new standards, reviewing existing ones, and recommending adoption or amendments. AISC submits its recommendations to CMVR-TSC for final approval, which, upon acceptance, are forwarded to MoRT&H for incorporation into CMVR.
The Automotive Industry Standards, overseen by the Automotive Research Association of India on behalf of the Automotive Industry Standards Committee, play a pivotal role in ensuring compliance with safety standards and emission norms. Under Rule 126 of the CMVR, various test agencies, including ARAI, Vehicle Research & Development Establishment, and Central Institute of Road Transport, are tasked with testing and certifying vehicles based on these standards and norms. Manufacturers must submit vehicle prototypes to these agencies for evaluation, and upon successful compliance, receive certification to proceed with production.
Emissions
Indian emission requirements for vehicles are governed by the Ministry of Road Transport and Highways (MoRT&H) in accordance with the Central Motor Vehicles Rules (CMVR). These regulations aim to reduce vehicular emissions and mitigate air pollution, thereby safeguarding public health and the environment.
The primary legislation governing vehicle emissions in India is the Bharat Stage (BS) emission standards. These standards specify the permissible limits for pollutants emitted by vehicles, including carbon monoxide (CO), hydrocarbons (HC), nitrogen oxides (NOx), and particulate matter (PM). Similar to the Euro emission standards adopted in Europe, the BS standards progressively tighten emission limits over time to encourage the adoption of cleaner and more efficient technologies.
India has transitioned through several stages of BS emission standards, with each stage introducing stricter emission limits. The latest stage, BS VI, is the most stringent and was implemented nationwide in April 2020. BS VI-compliant vehicles significantly reduce emissions of harmful pollutants, including particulate matter and nitrogen oxides, compared to earlier stages.
Under the BS VI standards, all vehicles, including passenger cars, commercial vehicles, and two-wheelers, must comply with strict emission norms. Manufacturers are required to equip vehicles with advanced emission control technologies such as selective catalytic reduction (SCR), diesel particulate filters (DPF), and exhaust gas recirculation (EGR) systems to meet these standards.
To enforce compliance with emission standards, the government has established testing and certification procedures. Vehicles undergo rigorous testing at authorized testing facilities to ensure that they meet the prescribed emission limits. Manufacturers must obtain certification from these testing agencies before their vehicles can be sold in the market.
In addition to BS emission standards, the government has also introduced measures to promote the adoption of cleaner fuels such as compressed natural gas (CNG), liquefied petroleum gas (LPG), and electric vehicles (EVs). These alternative fuels help reduce vehicular emissions and contribute to improved air quality in urban areas.
Overall, Indian emission requirements for vehicles play a crucial role in addressing air pollution and promoting sustainable transportation. By enforcing stringent emission standards and encouraging the adoption of cleaner technologies and fuels, India aims to reduce the environmental impact of vehicular emissions and create a healthier and more sustainable future for its citizens.
